Criminal Negligence Cause Death
R. v. L.M.
An industrial accident occurred at a small business. It was alleged that L.M. obstructed justice and was responsible for the death of an employee. After a lengthy preliminary hearing it was established that there was insufficient evidence of L.M.’s duty of care or direct actions contributing to the death of the employee. L.M. was discharged of both criminal negligence cause death and obstruct justice.
